I agree, gentlemen. Marriage is a religious institution. Get the government out of it completely, and let the Church decide whom will be married.

In fact, if the Church had any cajones, it would give up its tax-exempt status. It needs to stop serving two masters and get back to the spread of the Gospel.

Patrick Mulligan:

Re: "I don't think the government should be in the business of licensing marriage either."

We're 180-out on this one. I recently wrote my bishop urging the Catholic Church to renounce the authority to perform legal marriages and to limit them to sacramental marriages. Couples could also avail themselves of a legal ceremony if they wished.

Actually, in a rare, probably singular point of agreement with Cass Sustein, I don't think the government should be in the business of licensing marriage either. Marriage is a private, personal, religious institution. The only entity that should license it is the religious organization under which and for which it is undertaken. From a government/legal context, "marriage" is nothing more or less than a for-fee contract that serves to provide local governments with a steady stream of revenue. I do think it's hilariously ironic, however, that a guy who thinks the government should be in charge of harvesting organs from terminally ill patients without consent and that the constitution guarantees the right to a government-funded abortion suddenly finds the state so objectionable.
